13.3 Class Action Waiver

YOU AND TRUE LABS LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THIS ARBITRATION PROVISION SHALL BE NULL AND VOID.

13.4 Small Claims Court Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court in Orange County, California, for disputes or claims within the jurisdictional limits of that court.

You may opt out of this arbitration provision by sending written notice via our contact page within thirty (30) days of your first purchase from True Peptides. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of the arbitration provision.
